PYROTECHNIC ARTICLES

Manufacturers shall ensure that their products meet the essential safety requirements. The Notified Body (EU) and UK Approved Body (UK) must be involved in the conformity assessment procedures. The pyrotechnic articles listed in the Directive:

  • Fireworks (F1,F2,F3,F4)
  • Theatrical pyrotechnic articles (T1,T2)
  • Other pyrotechnic articles (mainly for technical purposes), e.g.: Gas Generators, Alarms, etc. (P1,P2)
  • Pyrotechnic articles for vehicles (P1,P2), e.g..: safety belt pretensioners, airbag modules

The pyrotechnic articles listed in the UK Regulation:

  • Fireworks (F1,F2,F3,F4)
  • Theatrical pyrotechnic articles (T1,T2)
  • Other pyrotechnic articles (it includes the pyrotechnic articles for vehicles too) (P1,P2)

Conformity assessment procedure to CE and UK CA mark

The conformity assessment procedure under the EU Directive and UK Regulation consists of two steps:

  • Design Phase - Type Examination (Module B)
  • Production Phase - Conformity to Type Based on Different Aspects (Module C2, D or E)

Both phases:

  • Module H: Compliance based on full quality assurance (for F4 class fireworks only).
  • In this case, Module B is not necessary because it also covers the design phase.

The purpose of the type examination is to assess whether the product meets the essential safety requirements (ESR) of the Directive or UK Regulation. This assessment must be carried out by a Notified Body (EU) or UK Approved Body (UK). For this reason, the relevant harmonised standards are used for conformity assessment procedures. According to the Directive and UK Regulation, products with similar characteristics are grouped into product families based on their appearance, parameters and function.

Compulsory tests required by Type Examination (Module B):

  • Functional test of the samples as received
  • Functional test after thermal conditioning of the samples
  • Functional test after mechanical conditioning of the samples
  • Product design verification

The manufacturer must provide the following information for the application:

  • The name and address of the manufacturer, if the application is made by an authorised representative, the name and address of this applicant.
  • Tax number
  • Declaration that the same application has not been lodged with any other Notified Body (EU) or UK Approved Body (UK)

  • Technical documentation
  • General description of the product
  • Main parts, components, production plans and sketches

Once the type-examination has proven that the product type complies with the ESR, it must be verified that the manufactured articles conform to the type certification before being placed on the EU or UK market.

When checking the production phase, the applicant can choose from the module system (based on preference and possibility) given in the Directive 2013/29/EU or Pyrotechnic Articles Safety Regulation (2015):

  • Module C2
    Conformity to type based on internal production control plus supervised product checks at random intervals. A detailed examination of all the items to be placed on the EU or UK market by the manufacturer.
  • Module D
    Conformity to type based on quality assurance of the production process. The manufacturer operates an approved quality system for the production, final product inspection and testing of the pyrotechnic articles concerned. The chosen Notified Body or UK Approved Body shall monitor the quality management system.
  • Module E
    Conformity to type based on product quality assurance. The manufacturer operates an approved quality system for final product inspection and testing of the pyrotechnic articles concerned. The chosen Notified Body or UK Approved Body shall monitor the quality management system.
  • Module G
    Conformity based on unit verification

Legal background:

Cultural habits and traditions vary greatly from one Member State to another. For this reason, Member States may take national measures to prohibit or restrict the purchase of certain categories of fireworks to consumers based on of public policy, security or environmental protection.

From 4 July 2017, all pyrotechnic article covered by Directive 2013/29/EU must comply with the ESR before being placed on the EU market.
From 1st January 2023, all pyrotechnic article covered by the Pyrotechnic articles safety regulation (2015) must comply with the ESR before being placed on the UK market.
